Planning Appeals

Navigating Planning Challenges with FitzGerald Ecology Expertise

In Ireland, where development and ecological conservation often intersect, the need for well-informed, ecologically considerate planning decisions is paramount. Our service is dedicated to ensuring that environmental concerns are not just heard but given the weight they deserve in the planning process.

The Role of Planning Appeals in Ecological Conservation

Planning appeals are a crucial mechanism in the democratic planning process, allowing individuals, communities, and organisations to voice their concerns and challenge decisions that could have significant environmental implications. These appeals ensure that development projects are scrutinised for their ecological impact and align with sustainable practices.

Why Engage in Planning Appeals?

  • Upholding Environmental Standards: Ensuring that planning decisions adhere to environmental regulations and standards.

  • Advocating for Sustainable Development: Championing development that balances ecological conservation with progress.

  • Community Representation: Giving a voice to those who are directly impacted by planning decisions.

Ensuring that environmental concerns are not just heard but given the weight they deserve.

FitzGerald Ecology’s Approach to Planning Appeals

Our approach to planning appeals is grounded in expertise, thorough analysis, and a commitment to environmental stewardship:

Expert-Led Analysis

  • Ecological Impact Assessment: We conduct detailed assessments of the potential ecological impacts of proposed planning decisions. This includes reviews of planning documentation for planning authorities, as well as third party appellants.

  • Impacts on Natura 2000 sites (Appropriate Assessment): We provide expert analyses of Appropriate Assessments, habitat surveys and management plans, protected species surveys, etc.

  • Regulatory Compliance Review: Our experts review whether planning decisions comply with existing environmental laws and regulations.

Strategic Appeal Formulation

  • Compiling Robust Evidence: We gather and compile strong, evidence-based arguments to support the appeal.

  • Clear and Persuasive Presentation: Our team ensures that the appeal is presented in a clear, coherent, and persuasive manner, emphasizing any ecological/environmental implications.

Collaborative Efforts

  • Stakeholder Engagement: We work closely with various stakeholders, including community groups, conservation organisations, and legal experts, to build a comprehensive appeal.

Safeguarding Rare Plant Species

In 2022, FitzGerald Ecology completed a full flora study and rare plant survey of four sub-sites within Turvey Nature Reserve, Co. Dublin. As part of this work, we were responsible for the transplantation of two rare plant populations which were at risk of damage from planned environmental engineering works in the area. This transplantation was conducted successfully. This flora study will inform future environmental engineering works to be carried out by the client within Turvey Nature Reserve in the coming years, which is partially within the Rogerstown Estuary Special Area of Conservation (SAC).
